 Cuando una empresa atraviesa un periodo de quiebre financiero o crisis puede existir una palabra que englobe este periodo el cual se le conoce como bancarrota. Este suele asociarse con unas situaciones extremas y negativas las cuales que pueden forzar a que las operaciones de la empresa disminuyan hasta su cierre.

Esto suele pasar cuando el negocio fracasa o las deudas se encuentran fuera de control, lo cual forzar al dueño a declararse en “bancarrota” para aliviar de forma parcial la situación y a su vez acabar con los reclamos de los cobradores. Es importante que sepamos, que al momento en que una empresa se declara en bancarrota, comienza un proceso para que puedan mejorar sus finanzas.

Normalmente la bancarrota es manejada en los tribunales federales, quienes se encargan de tomar las decisiones junto con los clientes. Entre este tipo de decisiones está en que la empresa decide que si paga o no las deudas pendientes que se encuentran en las manos del juez especializado, llegando así a la decisión final.

Cuando un deudor se declara en bancarrota, comienza el proceso. Se puede dar uno de dos resultados:

  • El indulto de la deuda
  • La reestructuración de la deuda

Tipos de bancarrota

Entre los tipos más comunes de bancarrota se encuentran los siguientes:

  • Liquidación: Este tipo de bancarrota es el más adecuado para todos aquellos individuos que también la pueden utilizar las empresas. Esta se enfoca en una forma más simple de bancarrota y por ello también recibe el nombre de “bancarrota directa” siendo la forma más común de bancarrota.

Asimismo la liquidación es la forma más adecuada para los consumidores con deudas sin aval y que pueden a su vez ser perdonados. También se puede solicitar este tipo de bancarrota si la empresa tiene préstamos que no han pagado, deudas de tarjetas de crédito, facturas médicas o préstamos personales.

  • Reorganización: La reorganización consiste en que los  empresarios que pasan por graves problemas financieros pueden optar por el Capítulo 11 (que es una opción adecuada para las empresas) o bancarrota por reorganización para poner sus finanzas en orden. Esto permite que las empresas puedan seguir funcionado ya que no permite que se paralice las operaciones del negocio. De tal modo, la empresa que se declara en bancarrota puede renegociar con sus acreedores y reestructurar algunos de los términos y de sus obligaciones financieras.

Un fideicomisario designado por el tribunal puede hacerse cargo de la dirección del negocio mientras dura el proceso de bancarrota
